FAIRVIEW PARK, Ohio -- Police have filed charges against David W. Powlowski, 60, of Fairview Park, after he was accused of hitting a student at Fairview High School Thursday.
Powlowski faces charges of aggravated vehicular assault, operating a vehicle while intoxicated and reasonable control.
In a video appearance Friday before Rocky River Municipal Court Judge Donna Congeni Fitzsimmons, Powlowski explained that he had driven to the high school to pick up his nieces.
Police agreed to allow Powlowski's release to a local hospital explaining that he has serious immediate medical needs. But the judge imposed strict requirements as a condition of his release.
"My concern is that the defendant doesn't use any alcohol because I don't want any other incidents similar to the incident for which he is on court right now," said Fitzsimmons.
She insisted Powlowski understand that he is not to drive under any circumstances.
"A pretrial condition of your bond is that you may not drive a vehicle for any reason and if there would be an instance where you were driving, this court will hold you in jail without bail; do you understand that?" she asked Powlowski, who acknowledged her, saying, "yes, ma'am."
The girl, who he is accused of striking with his vehicle, remained in a local hospital on Friday but was assuring friends over social media that she was going to be okay.
Powlowski was assigned an attorney by the court, claiming he is indigent. His arraignment was continued until Monday.
